Advance Decisions and Mental Health

To mark World Mental Health Day in October, Compassion in Dying has launched a new resource produced in collaboration with Mind called Advance Decisions and Mental Health. The factsheet was produced in response to enquiries both organisations have frequently received about mental health and planning ahead.

Many callers to their information line are concerned that simply because they have a mental health condition their Advance Decision may not be followed, due to a presumption that they lack capacity. Others wanted to know whether Advance Decisions are followed in the event of being sectioned.   There is clearly confusion and misunderstanding among the public about their rights under the 2005 Mental Capacity Act and how their mental health might affect these, and this new factsheet is designed to answer those questions in a clear, thorough, easy-to-understand format.
